Terms of Service
Terms and conditions for using the Aitrack B2B fleet management and GPS tracking platform: service, account, payments, customer data, AI and liability.

This website presents Aitrack and allows information requests. Browsing or sending an enquiry does not activate a subscription or enter into a service contract. The offer, order, plan and data processing agreement define the purchased service; validly agreed specific conditions and mandatory law prevail in case of conflict. Clauses requiring specific approval must be approved in the manner required by law.
Features marked beta, experimental or coming soon are not a promise of availability or a release date. Demo data and scenarios are illustrative. GPS and connectivity may involve delays, inaccuracies or interruptions; the service does not replace certified emergency or safety systems.
1. Acceptance of terms
By using the Aitrack platform you accept these Terms of Service. If you do not accept them, do not use the service. The service is intended for professionals and businesses (B2B use); by registering you declare that you act within your business activity.
2. Description of the service
Aitrack is a fleet management and GPS tracking platform provided as software-as-a-service, accessible via web, mobile app (iOS and Android) and API. It offers real-time location, route history, geographic areas, alerts, automations, reports and team management tools. Some features depend on the subscribed plan or are available as add-ons.
3. Account and registration
To use the service you must create an account providing truthful, up-to-date information. You are responsible for keeping your credentials confidential and for activity carried out through your account; we recommend enabling two-factor authentication. You can create sub-accounts for your team, with granular permissions: you remain responsible for their use.
4. Acceptable use
You agree to use the service only for lawful purposes. In particular:
- Monitoring people: if you monitor assets assigned to workers, you must comply with applicable law (in Italy, Article 4 of the Workers' Statute, with the required agreements or authorisations) and inform data subjects. You are the controller of that data.
- You must not access data or devices that are not yours, attempt unauthorised access, reverse-engineer the service or compromise its security.
5. GPS devices
Any GPS devices purchased from Aitrack must be installed in compliance with local law. Unless otherwise stated, devices are covered by a 24-month warranty. Aitrack is not responsible for non-compliant installations carried out by third parties.
6. Payments and subscriptions
Subscriptions are paid, with monthly or annual billing handled through Stripe. Unless otherwise stated:
- You may cancel at any time; the subscription remains active until the end of the period already paid.
- No refunds are provided for partial periods already billed.
- Any price changes are notified at least 30 days in advance.
7. Customer data and data protection
The data you upload or generate through the service (positions, records, events) remains yours. For this data Aitrack acts as processor (Art. 28 GDPR), processing it only to provide the service and on your instructions, under the data processing agreement (DPA) and the Privacy Policy. You are responsible for having a valid legal basis to process your drivers' data.
8. Artificial intelligence features
The service may include artificial intelligence features (for example driving behaviour analysis, fine estimation, predictive maintenance, a report and automation assistant). These tools are supportive: they do not make binding automated decisions about people, their outputs must be verified and remain under your responsibility and oversight. 9. Intellectual property
The software, the Aitrack brand, the graphics and the platform content are owned by the owner and protected by law. You are granted a limited, non-exclusive and non-transferable licence to use them for the duration of the subscription. The data you upload remains yours.
10. Limitation of liability
The service is provided "as is". While we strive for continuity and reliability, we do not guarantee uninterrupted or error-free operation. To the extent permitted by law, Aitrack's total liability is limited to the amount paid for the service in the 12 months preceding the event. Nothing in these terms excludes liability that cannot be excluded by law.
11. Termination
You may stop using the service and close your account at any time. We may suspend or close the account in case of breach of these terms or unlawful use, giving notice where possible. On termination, the retention and deletion terms described in the Privacy Policy apply.
12. Governing law and jurisdiction
These terms are governed by Italian law. Any dispute is subject to the exclusive jurisdiction of the Court of Pesaro, save for mandatory consumer-protection rules where applicable.
13. Changes to the terms
We may update these terms; the current version is always published on this page with the last-updated date. Material changes will be communicated with reasonable notice. Continued use of the service after an update constitutes acceptance.
